Resumen

El artículo 1642 del Código Civil y Comercial de la Nación debe ser interpretado en que las partes deben cumplir con el acuerdo, pero no constituye una cosa juzgada en sentido técnico, desde que puede dar lugar a una ejecución judicial en caso de incumplimiento. Se considera que incluso si no se requiere, es conveniente la aprobación del juez, de modo que aprobado por resolución judicial pueda concluir a la ejecución de la sentencia.

ABSTRACT:

The art. 1642 of the Civil and Commercial Code of the Nation establishes that the transaction produces the effects of the thing judged. It must be interpreted that the parties must comply with the agreement, but not that it constitutes a thing judged in a technical sense, since it can give rise to judicial execution in case of non-compliance. It is considered that even if it is not required, it is convenient to ask the judge for approval, so that approved by judicial resolution can lead to the execution of sentence.
