<p>En este trabajo se abordará el tenso equilibrio existente entre las fuerzas centrifugas y centrípetas del proceso de construcción del derecho internacional de los derechos humanos en Latinoamérica, a saber: las doctrinas del ius constituionale commune americanum y del margen de apreciación nacional. En tal sentido, nuestra hipótesis es que un análisis crítico de las tesis que proponen la consolidación de un derecho constitucional común latinoamericano, a través de la obra de la Corte Interamericana de Derechos Humanos en el ejercicio del control de convencionalidad, arroja la conclusión de que aquel, por el momento, no es más que un ordenamiento de mínimos, y que, como consecuencia, la doctrina del margen de apreciación nacional seguirá estando vigente en esta parte del mundo. <br><strong>Abstract</strong><br>This paper will address the tense balance between centrifugal and centripetal forces in the process of building international human rights law in Latin America, namely: the doctrines of the iusconstituionale commune americanum and the national margin of appreciation. In this sense, our hypothesis is that a critical analysis of the theses that propose the consolidation of a Latin American common constitutional right, through the work of the Inter-American Court of Human Rights in the exercise of conventionality control, yields the conclusion that that, for the moment, is nothing more than a minimum order, and that, as a consequence, the doctrine of the national margin of appreciation will continue to be in force in this part of the world.</p>

<p>La constitución argentina de 1853 no incluye reglas sobre el ejercicio del control de constitucionalidad; a partir de cuya ausencia la Corte Suprema de Justicia de la Nación se adjudica una auto atribución monopólica para el diseño del sistema y su ejercicio; creando las reglas del tradicional sistema de control de constitucionalidad federal argentino. No obstante, frente a este clásico sistema, desde hace algunos años la propia Corte Suprema de Justicia de la Nación propone una flexibilización del diseño original y una mutación sobre sus notas caracterizantes con vocación hacia la hibridación del sistema. Este trabajo propone la identificación y descripción de dicho proceso jurisprudencial mutativo sobre una de las notas caracterizantes del tradicional sistema de control de constitucionalidad argentino: el monopolio judicial del control; y explorar desde allí la injerencia del órgano ejecutivo en materia de control de constitucionalidad sobre normas presuntamente inconstitucionales.</p> <p><br><strong>Abstract</strong><br>1853 Argentine constitution does not include rules about constitutional review; from whose absence the National Supreme Court of Justice takes on the self attributed monopoly of the construction of its classics rules. However, against this classic review system, the National Supreme Court of Justice has proposed a flexibilization of the original design and a mutation on its characteres in order to promote an hybridization of the system. <p>La acción declarativa de inconstitucional, como herramienta para asegurar la supremacía constitucional, es una vía procesal autónoma y de excepción, de trámite sumario o sumarísimo, que se perfila como el instrumento más eficaz para interpelar la actuación de los jueces a los fines de salvaguardar los valores, derechos y garantías que la Constitución Nacional consagra, cuando una norma legal provincial, municipal o administrativa pudiera reputarse contraria al orden constitucional. Siendo esta acción esencialmente declarativa y de carácter preventivo, la tutela judicial debe ser instada, por regla general, antes de producida la lesión a los derechos constitucionales que se invocan. Ella tiene por objeto el análisis de la adecuación constitucional de un acto normativo determinado, de alcance general, siendo su finalidad la consiguiente declaración de invalidez o inaplicabilidad de la norma irregular en el caso concreto y respecto de aquel cuyo derecho subjetivo o interés legítimo ha sido amenazado o afectado.</p> <p><br><strong>Abstract </strong><br>The declarative action of unconstitutionality, as a tool to ensure constitutional supremacy, is an autonomous and exceptional path, of summary procedure, which is emerging as the most effective instrument to incite the intervention of judges in order to safeguard the values, rights and guarantees that the National Constitution establish, when a provincial, municipal or administrative law could be considered in violation to the constitutional order. Since this action is essentially declarativ and of a preventive nature, legal protection must be urged, as a general rule, before the violation to the invoked constitutional rights occurs. Numerosas provincias entre las que se cuentan Buenos Aires, Mendoza, Neuquén, Chaco, San Juan, Rio Negro, entre otras han incorporado ya el diseño de juicio por jurado clásico o anglosajón.</p> <p>El presente trabajo analiza este movimiento de la reforma y los cuestionamientos a la constitucionalidad de la instauración del juicio por jurado clásico por implicar la introducción del veredicto inmotivado a través del análisis crítico de los recientes fallos de la Corte Interamericana de Derechos Humanos y la Corte Suprema de Justicia de la Nación que analizaron este problema constitucional y poniendo de manifiesto cuales los argumentos por las cuales estas decisiones son contradictorias con la práctica interpretativa de ambos tribunales que han consagrado un derecho autónomo a la motivación y a un sistema de revisión amplio de las sentencias, como garantías del debido proceso.</p> <p><br><strong>Abstract</strong><br>A strong criminal procedural reform movement is underway in Argentina, incorporating citizen participation in the administration of justice through the institution of jury trials. Numerous provinces among which are Buenos Aires, Mendoza, Neuquén, Chaco, San Juan, Rio Negro, among others, have already incorporated the design of trial by classical or Anglo-Saxon jury.</p> <p>The present work analyzes this movement of the reform and the questions to the constitutionality of the establishment of the trial by classic jury for implying the introduction of the unmotivated verdict through the critical analysis of the recent decisions of the Inter-American Court of Human Rights and the Supreme Court of Justice of the Nation that analyzed this constitutional problem and showing that the arguments by which these decisions are contradictory with the interpretative practice of both courts that have enshrined an autonomous right to motivation and a system of comprehensive review of sentences, as guarantees of due process.</p>

<p>La denominada “Constitucionalización del derecho privado” suscita algunas controversias en la doctrina por las diferentes posiciones asumidas en orden a su significado y alcance. Sin embargo, la introducción de los “nuevos derechos y garantías” en la re- forma constitucional de 1994, como también la valorable recepción legislativa de los derechos humanos (Art. 75, inc. 22, CN), que constituyen derechos fundamentales de jerarquía supranacional, exigen del Derecho Privado su adecuación a estas nuevas fuentes y no únicamente su subordinación (Art. 31, CN). El nuevo código civil y comercial no desatendió esa directiva, disponiendo su interpretación conforme a los Tratados sobre derechos humanos, los principios y los valores jurídicos, de modo coherente con todo el ordenamiento” (Art. 2 CCCN). La meritoria positivización de los Derechos Humanos, en la Constitución Nacional, impuso su aplicación en el nuevo código, fiel al efecto operativo de aquella. <br><strong>Abstract</strong><br>The so-called “private law constitutionalization ” raises some controversies in the legal doctrine regarding its meaning and scope of action. However, the inclusion of a new chapter in the 1994 constitutional reform, under the heading “New Rights and Guarantees” (second section of the first part), as well as the valuable reception of the human rights legislation (art. 75, 22, CN) which constitute fundamental rights with supranational hierarchy, demand the suitability of the private law and not only its subordination (art. 31, CN). The new civil and commercial code has not neglected this directive,by stating its interpretation considering the dispositions contained in the human rights treaties, the principles and juridical values, consistently integrated with the whole system (art. 2, CCCN). The commendable positivization of human rights in the national constitution has imposed its regulation in the new civil and commercial code, following the operative effect mandate by the constitution.</p>

<p>Se han elaborado tipologías de constituciones centrando sus diferencias en su carácter ‘histórico’, o ‘racional’ o ‘no histórico’. Como una observación general, puede decirse que todas las constituciones son producto de fuerzas y procesos históricos. Pero algunos documentos en particular muestran una acendrada historicidad, como Gran Bretaña. Otros documentos contienen algunos condimentos históricos, como la Constitución ar- gentina de 1853. Ello hace que sobresalgan en el concierto comparatista de hoy, acostumbrado a productos enteramente racionalistas. Por lo demás, la historicidad puede revelarse en ciertas partes, como en los preámbulos y en las “cláusulas de eternidad”.<br><strong> Abstract<strong><br></strong></strong>Typologies were built by authors, noting ‘historic’ and ‘non-historic’ or ‘rational’ constitutions. As a general observation, all constitutions are product of historical forces and processes. But some documents in particular reveal a special historic streak. Great Britain is a case in point. Other constitutions show some historical features, like the Argentine Constitution of 1853. These peculiarities make them outstanding documents in nowadays Comparative Constitutional Law, mainly devoted to entirely rational by-products. Moreover, the historic vein reveals itself also in preambles and “eternity clauses”.</p>

Para luego adentrarse en la normativa que tiene jerarquía constitucional en Argentina como la Convención sobre los Derechos de las Personas con Discapacidad, igualmente se analizan casos jurisprudenciales de Comisión Interamericana como la Corte Interamericana de Derechos Humanos han intervenido en casos originados por la violación de derechos de las personas con discapacidad, y la justicia federal. Finalmente, se concluye con una relexión personal sobre la discapacidad como cuestión social, diferenciando el rol normativo, y judicial en Argentina.</p> <p><strong>Abstract</strong></p> <p>In this article an analysis is made of the evolution in the various historical and / or social contexts of people with disabilities. To later delve into the regulations that have constitutional hierarchy in Argentina such as the Convention on the Rights of Persons with Disabilities, jurisprudential cases of the Inter-American Commission are also analyzed, such as the Inter American Court of Human Rights that have intervened in cases originating from the violation of rights people with disabilities, and federal justice. Analiza las fuentes del Derecho Administrativo reconocidas en el texto constitucional, así como importancia de los Principios Generales en la construcción de un sistema organizado y coherente. Con relación a la organización, se analiza la posición institucional del Poder Ejecutivo y las distintas formas de gestión administrativa, en particular las descentralizadas. Partiendo de los principios generales, se analiza la normativa relativa a la actividad administrativa y la importancia de los medios de defensa de las situaciones jurídicas de los particulares, así como las bases del servicio público.<br><strong>Abstract</strong><br>The article aims to identify the links between Administrative Law and Constitutional Law in Uruguay, also making some comparative references with Argentine Law. It focuses on the constitutional roots of Public Administration in Uruguayan Law based on the idea of centrality of the human person. It analyzes the sources of Administrative Law recognized in the constitutional text, as well as the importance of the General Principles in the construction of an organized and coherent system. Regarding the organization, the institutional position of the Executive Branch and the diferent forms of administrative management, particularly decentralized ones, are analyzed. <p>Las sentencias exhortativas de la Corte Suprema de Justicia de la Nación son un instituto jurídico de reciente y novedosa aparición en nuestro sistema argentino de derecho. Entre los años 2005 a 2012, la Corte Argentina, llegó el punto más álgido en lo que respecta a la producción y dictado de este tipo de sentencias atípicas, sobre todo en casos complejos y de transcendencia pública e institucional que involucraban a su vez derechos fundamentales. Nuestro país, está dando los primeros pasos en lo que respecta al dictado de sentencias exhortativas y en el camino se ha topado con algunos obstáculos al momento de la ejecución de sentencia. Este trabajo propone la identiicación y descripción de dichas dificultades con las que deben lidiar los operadores jurídicos, víctimas y actores a los fines de hacer realidad los derechos declarados en las sentencias exhortativas de la Corte.<br><strong>Abstract</strong></p> <div>The exhortative sentences of the Supreme Court of Justice are a legal institute of recent and novel appearance in our Argentine system of law. From 2005 to 2012, the Argentine Supreme Court reached to the highest point with regard to the production and delivery of this type of atypical sentences, especially in complex cases of public and institutional transcendence which involved fundamental rights.
